TERMS AND CONDITIONS FOR THE SALE OF THE PRODUCTS

1. GENERAL

1.1 All Customer shall be bound by these terms and conditions. No term or condition contained in the Order shall vary, supersede, amend or delete any of these terms and conditions unless expressly agreed in writing by Water Hippos.

1.2 Any return, replacement or refund of the Product(s) shall subject to these terms and conditions (“T&C for Products”) and such other procedures as may be determined by Water Hippos from time to time, in its sole and absolute discretion.

1.3 Each Customer’s application for return, replacement or refund of the Product(s) will be assessed based on this T&C for Products or a case-by-case basis, at Water Hippos’ sole discretion. Water Hippos’ decision shall be final and the Customer agrees to be bound by the same.

1.4 The Customer hereby agrees to be bound by this T&C for Products and any other policies and terms and conditions as may be posted on the Platform from time to time at Water Hippos’ sole discretion (“Other Terms”).

2. DEFINITIONS

2.1 Unless otherwise defined or the context otherwise requires, any capitalized words in this T&C for Products shall have the same meaning as found in the General Terms of Use. This T&C for Products shall form an integral part of the General Terms of Use.

2.2 The following terms shall have the following respective meanings:

“Contract” means the contract between Water Hippos and the Customer for the sale and purchase of the Product(s) comprising the Order, acceptance of the Order by Water Hippos, this T&C for Products and Other Terms; and
“Order” means an offer to purchase the Product(s) made by you.

3. ACCOUNT ANDSECURITY

3.1 To purchase the Products, the Customer is required to create an account at the Platform in order to gain access to the use of any services and functionality at the Platform that Water Hippos may establish and maintain at all material times and in its sole discretion.

3.2 The Customer’s permission to use the Platform is conditional upon the Customer’s agreement that the Customer will provide accurate information when creating an account or registering with us. WaterHippos has the absolute discretion to reject, approve, suspend or terminate the Customer’s creation of an account with Water Hippos and/or the Customer’s usage of the Platform.

3.3 By creating an account, the Customer agrees to receive email newsletters and communication from Water Hippos. All Users of our Platform have the option to discontinue receiving communication from us byway of email or newsletters. To discontinue or unsubscribe for our Platform, please send an email that you wish to unsubscribe tocc@waterhippos.com orsimply login to your Water Hippos’ account and head to the notification settings to disable it. Please take note that your account may be affected if you have anaccount with us and opt-out of communication.

3.4 The User hereby acknowledges and consents that WaterHippos may access, preserve and disclose the Customer account information and Content (as defined below) to any legal regulatory, or government authority, the relevant rights owner, or third parties if required to do so by the Applicable Laws pursuant to an order of court or lawful request by any governmental or regulatory authority having jurisdiction over Water Hippos in accordance with the terms of the Privacy Policy.

3.5 The Customer is solely responsible for the activity that occurs on the Customer’s account even if such activities or uses were not committed by the Customer, and the Customer must keep its account password secure. If a legal disputes or law enforcement action is commenced related to the Customer’s account for any reason, Water Hippos may terminate the Customer’s account immediately with or without notice. WaterHippos shall not be responsible or liable, directly or indirectly, in any way for any loss or damage of any kind incurred as a result of, or in connection with, the Customer’s failure to comply with this section.

3.6 The Customer must notify Water Hippos immediately of any breach of security or unauthorized use of its account. Water Hippos shall not be liable for any losses caused by any unauthorized use of the Customer’s account.

4. ORDERS

4.1 By placing an Order on the Platform, the Customer is offering to purchase the Product(s) on and subject to all the terms contained herein as well as the Other Terms. Representations of Products and/or Services for sale made by Water Hippos via the Platform do not constitute an offer to sell but an invitation to treat. Water Hippos reserves the right to reject an Order, without affording any reason.

4.2 The Customer is responsible for ensuring that the terms of the Order and any applicable description and specification are complete and accurate before proceeding with your Order with us. WaterHippos reserves the right to accept the Order in whole or in part. Cancellation of Order can be done at any time before delivery of the Product is arranged by Water Hippos, subject always that you will not be able to cancel your Order once the Order has been arranged for delivery or has been delivered or in such other circumstance prescribed by Water Hippos.

4.3 Any samples, drawings, descriptive matter, or advertising produced by Water Hippos and any descriptions, specifications or illustrations contained in Water Hippos’ catalogues, brochures and/or this Platform are produced for the sole purpose of giving an approximate idea of the Products described in them. They shall not form part of the contract or have any contractual force.

4.4 Once the Order is accepted and completed upon successful payment of the same by the Customer, an email notification will be issued to the Customer, thereafter the Product(s) will be arranged for delivery by Water Hippos or its appointed logistics partner in accordance with the terms and conditions under Clause 6.

4.5 Whilst Water Hippos will try and ensure that all details, descriptions and prices which appear on the Platform are accurate, errors (including processing errors) may occur. Water Hippos do not warrant that the Products descriptions or other content or specifications are accurate, complete, reliable, current, or error-free. Water Hippos also reserves the right to alter the Products (including its specifications, promotion details, pricing etc.) available on the Platform.

4.6 If Water Hippos discovers an error in the price or payment of the Products which the Customer has ordered, WaterHippos will inform the Customer of this as soon as possible and provide the Customer with an option of reconfirming the Order at the correct price or cancelling it. If Water Hippos is unable to contact the Customer within two (2)business days, the Order is deemed to be cancelled. If the Order is cancelled and the Customer has already paid for the Product, the Customer will receive a full refund in respect of the Product.

4.7 The information pertaining to the Products may also contain typographical errors or other errors or inaccuracies and may not be complete or current. Water Hippos therefore reserves the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. Water Hippos also reserves the right to refuse to fulfil any Orders that the Customer may place based on information on the Product that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding description, specifications, pricing, shipping or payment terms.

5. PRICE AND PAYMENT

5.1 Price and payment shall be governed by this T&C for Products, Other Terms and the details and information of the Product when the Customer placed the Order on the Platform. In the event of conflict between this T&C for Products, Other Terms, Order, the Order shall prevail to the extent of the conflict or inconsistency. The price of the Products shall be the price set out in the Order.

5.2 The price of the Product is exclusive of the sale and service tax (“SST”), costs and charges of delivery and handling of the Product (“Other Charges”), which will be shown to the Customer upon placing the Order. References to SST shall automatically include all other value added taxes that may be imposed by the Government from time to time.

5.3 You should carefully read the Order details and review information such as price, charges, and such other terms and conditions for the Product(s) before purchasing the Product(s). You shall make payment for the Products upon placing the Order through our Platform using the various payment methods made available on the Platform.

5.4 Water Hippos may invoice the Customer for such other costs or expenses incurred by Water Hippos on or at anytime after the completion of delivery (“Invoice”). The Customer shall forthwith pay the Invoice in full and in cleared funds based on the timeline for payment as prescribed in the Invoice, failing which Water Hippos reserves the right to charge a late payment interest at the rate of eight percent (8%) per annum, calculated on a daily basis from the date of the Invoice sum became due until full settlement of the same.

5.5 The Customer shall pay all amounts due under the Contract in full without any set-off, counterclaim, deduction or withholding (except for any deduction or withholding required by law). WaterHippos may at any time, without limiting any other rights or remedies it may have, set off any amount owing to it by the Customer against any amount payable by Water Hippos to the Customer.

5.6 We may, by giving notice to the Customer at any time before delivery, increase the price of the Product(s) to reflect any increase in the cost of the Product(s) that is due to:

any factor beyond our control(including but not limited to increases in taxes and duties, increases inlabour, transportation, delays, materials and other manufacturing costs); or
any request by the Customerto change the delivery address, date(s), quantities or types of Product(s)ordered.

5.7 Water Hippos will notify the Customer if for any reason Water Hippos is unable to process the Customer’s Order, or any part of it (in which case Water Hippos shall not take payment from the Customer in respect of the cancelled Order, or the partially cancelled Order). The circumstances where Water Hippos may not be able to process and accept the Order includes but is not limited to:

where the Product(s) that the Customer has ordered is no longer available in stock;
where the payment has not been authorised;
where Water Hippos has identified a description error on the Products; and/or
where the Customer has not complied in any way with the terms herein and Other Terms.

5.8 Water Hippos takes no responsibility and assumes no liability for any loss or damages arising from Product information and/or Water Hippos’ inability to process the Customer’s Order and/or payer information entered by the Customer or wrong remittance by the Customer in connection with the payment for the Order. Water Hippos reserves the right to check whether the Customer is duly authorized to use certain payment method, and may suspend the transaction until such authorization is confirmed or cancel the relevant transaction where such confirmation is not available or when Water Hippos has verified that the relevant transaction is an unauthorized payment.

5.9 Where applicable, the Customer warrants that the credit or debit card details that the Customer provides is of the Customer’s own credit or debit card and that the Customer has sufficient funds to make the payment.

6. DELIVERY

6.1 Water Hippos will arrange the Product(s)ordered by the Customer to the location set out in the Order or such other location as the parties may agree (“Delivery Location”). Water Hippos may, at its sole and absolute discretion, charge the Customer any and all costs and expenses of delivery and handling of the Product. The delivery fees and/or any revision of such will be posted on the Platform by Water Hippos from time to time. Delivery of the Product(s) shall be completed on the arrival of the Product(s) at the Delivery Location.

6.2 It shall be the responsibility of the Customer to ensure that the Delivery Location (including access to the same) is secure and further to ensure that Water Hippos has unrestricted and unimpeded access to the same. The Customer shall fully indemnify Water Hippos against any loss, damage and injury that Water Hippos may suffer as a result of the Customer’s breach of its aforementioned obligation.

6.3 Any dates quoted for delivery are approximate only, and the time of delivery is not of the essence.

6.4 If the Customer fails to accept delivery of the Product(s) when they arrive at the Delivery Location, then: -

Water Hippos or its appointed logistic partner will contact you to make another appointment for delivery. However, this will result in a new delivery order and is therefore chargeable, at the expense of the Customer. The Customer shall be liable for the additional costs and expenses in relation to such delivery; and
Water Hippos or its appointed logistic partner shall store the Product(s) until the next delivery takes place, Water Hippos is entitled to charge the Customer for all related costs and expenses including storage fee and Water Hippos shall have no liability to the Customer for damage to the Water Hippos occurring this period of storage.

7. TITLE, RISK AND OWNERSHIP

7.1 Riskin the Product(s) shall pass to the Customer on its delivery to the Customer in accordance with Clause 6 of these T&C for Products. Title in the Product(s)shall pass to the Customer on receipt by Water Hippos of full and cleared payment for the price of the Product(s) (including any applicable delivery and handling charges). Water Hippos retains the right to access, repossess and recover any Product(s) which is not fully paid by the Customer.

8. QUALITY OF THE PRODUCTS

8.1 Water Hippos warrants that on delivery, and for any Warranty Period, the Product(s) shall be free from material defects in material and workmanship. ‍

8.2 Subject to Clauses 8.3 and 8.4below, the Customer shall give notice in writing to Water Hippos: ‍

within twenty-four (24) hours in the case of damage during delivery or a defect discoverable on reasonable inspection of the Product(s) upon receipt of delivery; or
in the case of a defect which only becomes reasonably discoverable after the date of delivery, within twenty-four(24) hours of the date when the Customer could have discovered the defect on reasonable inspect of the Product(s),

and subject always that Water Hippos is given an opportunity of examining such defective Product(s) (“Defective Product(s)”). The Customer shall return such Defective Product(s) to WaterHippos or arrange with Water Hippos for a pick-up of the said Defective Product(s) at the costs of Water Hippos.

8.3 Water Hippos shall, at its sole and absolute discretion, repair or replace the Defective Product(s), or refund the price of the Defective Product(s) in full. ‍

8.4 Water Hippos shall not be liable for the warranty set out in Clause 8.1 above in any of the following events: - ‍

the Customer has not complied with Clause 8.2;
the Customer makes any further use of the Defective Product(s) after giving notice in accordance with Clause 8.2;
the defect arises because the Customer failed to comply with the Water Hippos agent or representative’s oral or written instructions as to the storage, commissioning, installation, use and maintenance of the Product(s);
the Customer alters or repairs such Product(s) without the written consent of Water Hippos; or
the defect arises as a result of fair wear and tear, wilful damage, negligence, or abnormal storage or working conditions by the Customer.

9. RETURNAND REFUND POLICY

9.1 Unless otherwise specified by Water Hippos on this Platform or on the terms of sale for a Product, Water Hippos has a 30-dayreturn policy. Water Hippos will accept a return of the Product(s) for a refund of the purchase price, less the original shipping and handling costs, provided such return is made within thirty (30) days of delivery and such Product(s) is returned in their original condition (i.e., the Product(s) is unused, unopened, in the original packaging, and in like-in condition). The Customer should ensure the Product(s) including any complimentary product(s) such as its components and/or accessories that come with the Product(s), be returned to Water Hippos. Water Hippos may reject the Product(s) if there is damage to the Product(s) and/or Product’s packaging by the Customer (other than damage caused by Water Hippos during delivery). ‍

9.2 To qualify for a return and refund, Water Hippos must be notified within thirty (30) days from the date of receipt. After thirty (30) days from the date of receipt, Water Hippos is not obligated by any means to accept the return of the Product(s) and refund any money paid for the said Product(s) for any reason.‍

9.3 In the event where Water Hippos has accepted the Product(s) to be returned, the Customer is required to deliver the Product to Water Hippos or to arrange a pick up with Water Hippos at the Customer’s cost. In case of defective, damaged or incorrect Product(s) at the fault of Water Hippos, Water Hippos will bear all costs associated with there turn and refund or replacement, including the shipping fee. If the return is not the result of Water Hippos’ error, any costs associated with the return shall be borne by the Customer.‍

9.4 The Customer will only be refunded after Water Hippos has received the returned Product(s). The refund will be credited to the Customer’s credit/debit card, designated bank account or by cash, whichever the User used for the payment of the Product. ‍

9.4 For the avoidance of doubt, any monies to be refunded pursuant to a successful application shall be subject to a deduction of administrative charges as may be imposed by Water Hippos, from time to time, in its sole and absolute discretion or such other charges as maybe imposed by any third party. ‍

10. WARRANTY

10.1 Unless otherwise specified by Water Hippos on this Platform or on the terms of sale for a Product, Water Hippos’ Products are generally covered by warranty within the warranty periods specified in and subject to the respective warranty sheets (“Warranty Sheets”) for each Product (“Warranty Period”). To be eligible for the warranty, (i)the Product(s) must be one that purchased directly through Water Hippos’ Platform, its authorized dealers and service providers (“Authorized Persons”);and (ii) the Customer shall comply with these T&C for Products. Proof of date of purchase and proof of ownership may be required when making a claim under this warranty. The terms of the Warranty Sheets form an integral part of the terms of these T&C for Products. If there is conflict between the T&C for Products and the Warranty Sheets, the terms of the Warranty Sheets shall prevail, to the extent of such inconsistency.

10.2 Notwithstanding the provisions herein, if the Products was purchased by the Customer from a third party reseller (“Third Party Reseller”), meaning a party other than Water Hippos’ Authorized Person, all warranty related matters shall be governed by the relevant warranty policy of the Third Party Reseller. Water Hippos shall not be responsible or liable to facilitate and/or honour the warranty policy of the Third Party Reseller. You agree to waive any claim against Water Hippos with respect to the Third Party Reseller and shall bring any claim that you may have against the Third Party Reseller.

10.3 Water Hippos reserves the right to transfer fully functional components or parts from any failed Product(s), if required. Any component or part replaced shall become our property.

10.4 You shall promptly report to us within the Warranty Period any defects in the Product(s) resulting from faults in materials. Once your warranty claim is received by Water Hippos, WaterHippos may investigate the cause of the damaged part(s) and/or component(s) and if Water Hippos determines that the fault with the Product is a consequence of the manufacturer’s defect in materials, we will repair or, at our sole and absolute discretion, replace any defective part and/or component which fails within the Warranty Period. All claims must be made within the respective Warranty Period. For the avoidance of doubt, the replacement of the part(s)and/or component(s) by Water Hippos to the Customer does not include any ancillary services such as delivery, installation, testing and maintenance, Water Hippos is entitled to charge additional costs for such any ancillary services if requested by the Customer.

10.5 All Product(s) must be installed by you in accordance with the installation instructions and/or manual, supplied with the Product(s) and in accordance with all relevant statutory requirements.

10.6 Where a defective component is replaced under this warranty, the balance of the Warranty Period will remain effective. However, the Customer shall take note that the replaced part does not carry a new warranty.

10.7 The warranty only applies to the Product(s) with its original or genuine component parts and therefore does not cover any plumbing or electrical parts supplied by third party installer and not an integral part of the water heater, such as pressure limiting valve, stop cock, non-return valve, electrical switches, pumps or fuse.

10.8 Our warranty shall become null and void in the event where any part of the Product(s) has been dismantled and re-installed, parts changed or repaired by any person other than WaterHippos or its authorized technician or agent.

10.9 Water Hippos shall in no event be liable to the cost of utilities incurred for this warranty claim.

10.10 The warranty for the Product(s) shall not apply to the following, in which where repairs will be carried out at the costs of the Customer: -

damage and/or defect caused by normal wear and tear, improper use or mismanagement, operation of the Product rather than in accordance with the operating manual or instructions or attachment sheet, use of the Product in a manner not reasonably contemplated by Water Hippos, unauthorised modification of the Product(s) or subjection of the Product(s) to unusual or unrecommended physical, environment, electrical stress, faulty plumbing or high water pressure;
damage caused, directly or indirectly by excessive water pressure, temperature and/or thermal input or corrosive atmosphere;
cosmetic damage, including but not limited to dents, cracks, scratches and stains;
damage caused by improper testing, demonstration, maintenance, installation, adjustment or alteration of any kind;
damage caused by part or parts of a Product(s) not supplied or approved by Water Hippos;
damage caused by service or repairs performed by anyone who is not a representative of Water Hippos or Water Hippos’ authorised technician or agent;
damage caused by accident, abuse, floods, fire, winds, earthquake, lightning or other external causes; and/or
such other exceptions stipulated in the respective warranty sheets.

10.11 This warranty does not apply to any consumables. Consequently, no warranty applies to the life of any filtration cartridge installed within the Product(s) as cartridge life may vary according to water quality and the rate of water consumption.

10.12 Water Hippos’ Product(s)are designed specifically for use in a domestic, residential location. Unless otherwise permitted by Water Hippos, inappropriate installations, such as in a commercial environment (including residential care homes or medical facilities),will invalidate the warranty.

10.13 To the fullest extent permitted by law, this warranty excludes any and all claims for loss or damage suffered by the Customer through the use of or resulting from the non-operation or ineffective operation of the Product(s) or any part thereof including loss or damage to any other goods, furnishings and/or property of whatsoever description or any other consequential loss or damage either directly or indirectly due to negligence, loss of use, malfunction, defect, damage, breakdown or leakage from the Product(s) whatsoever and howsoever arising.

11. SUPPLY OF SERVICES

Where the Customer purchases the Product(s) in connection with the Services, such provision of the Services will be governed by the terms and conditions for the provision of Services. ‍

12. LIABILITY AND INDEMNITY

In no event shall Water Hippos be responsible for any loss, damage, or injury (including damage to property)arising out of or related to this T&C for Products and other Terms or caused or contributed to in any way by the use and operation of the Products. Notwithstanding any other provision of this T&C for Products and other Terms, in the event where WaterHippos is responsible for the loss or damage, the total liability of Water Hippos to the Customer or to any other party shall be only limited to the purchase price of such Product(s).

13. ERRORS IN WATER HIPPOS’ DOCUMENTS

Clerical errors and misprints in computation, typing or otherwise in the Platform, Products’ description, specification and/or Water Hippos’ documentation including but not limited to catalogues, price lists, quotation, dispatch dockets, invoices and statements, or adjustment notes shall be subject to correction by Water Hippos by means of reissue of the document or by adjustment advices.

14. WAIVER

No conduct by Water Hippos with respect to any default of the Customer and the performance of any obligation or condition of this T&C for Products shall be deemed to be a waiver of that or any other obligations or condition.

15. VARIATION

WaterHippos reserves the rights at anytime, at its sole discretion, to change, amend or otherwise modify any part of this T&C for Products by posting the relevant amended and restated this T&C for Products on the Platform. Such amendments are effective as of the date of posting, and the continued usage of Water Hippos’ Platform signifies the acceptance of the updated or modified this T&C for Products.

TERMA DAN SYARAT UNTUK JUALAN PRODUK

1. AM

1.1 Semua Pelanggan adalah terikat dengan terma dan syaratini. Tiada terma atau syarat yang terkandung dalam Pesanan boleh mengubah, menggantikan, meminda atau memadam mana-mana terma dan syarat ini melainkan dipersetujui secara bertulis oleh Water Hippos.

1.2 Sebarang pemulangan, penggantian atau bayaran balik Produk hendaklah tertakluk kepada terma dan syarat ini (“T&C untukProduk”) dan prosedur lain yang akan ditentukan oleh Water Hippos darisemasa ke semasa, mengikut budi bicara mutlaknya.

1.3 Setiap permohonan Pelanggan untuk pemulangan, penggantian atau bayaran balik Produk akan dinilai berdasarkan T&C untuk Produk ini atau berdasarkan kes demi kes, mengikut budi bicara mutlak WaterHippos. Keputusan Water Hippos adalah muktamad dan Pelanggan bersetuju untuk terikat dengannya.

1.4 Pelanggan bersetuju untuk terikat dengan T&C untuk Produk ini dan sebarang dasar serta terma dan syarat lain seperti yang dipaparkan pada Platform dari semasa ke semasa mengikut budi bicara mutlak Water Hippos (“Terma Lain”).

2. DEFINISI

2.1 Melainkan ditakrifkan sebaliknya atau konteks menghendaki sebaliknya, mana-mana perkataan berhuruf besar dalam T&C untuk Produk inihendaklah mempunyai makna yang sama seperti yang terdapat dalam Syarat Penggunaan Am. T&C untuk Produk ini hendaklah menjadi sebahagian daripada Syarat Penggunaan Am.

2.2 Istilah berikut hendaklah mempunyai maksud berikut:

“Kontrak” bermaksud kontrak antara Water Hippos dan Pelanggan untuk penjualan dan pembelian Produkyang terdiri daripada Pesanan, penerimaan Pesanan oleh Water Hippos, T&C untuk Produk ini dan Terma Lain; dan
“Pesanan” bermaksud tawaran untuk membeli Produk yang dibuat oleh anda.

3. AKAUN DAN KESELAMATAN

3.1 Untuk membeli Produk, Pelanggan dikehendaki membuat akaun di Platform untuk mendapatkan akses kepada penggunaan mana-mana perkhidmatan dan kefungsian di Platform yang Water Hippos boleh menubuhkan dan menyelenggara pada setiap masa material dan mengikut budi bicara mutlaknya.

3.2 Kebenaran Pelanggan untuk menggunakan Platform adalah bersyarat dengan persetujuan Pelanggan bahawa Pelanggan akan memberikan maklumat yang tepat semasa membuat akaun atau mendaftar dengan kami. WaterHippos mempunyai budi bicara mutlak untuk menolak, meluluskan, menggantung atau menamatkan akaun Pelanggan dengan WaterHippos dan/atau penggunaan Platform oleh Pelanggan.

3.3 Dengan mencipta akaun, Pelanggan bersetuju untuk menerima surat berita dan komunikasi e-mel daripada Water Hippos. Semua Pengguna Platform kami mempunyai pilihan untuk berhenti menerima komunikasi daripada kami melalui e-mel atau surat berita. Untuk menghentikan atau menyahlanggan Platform kami, sila hantar e-mel yang anda ingin menyahlanggan ke cc@waterhippos.com atau log masuk ke akaun Water Hippos andadan pergi ke tetapan pemberitahuan untuk melumpuhkannya. Sila ambil perhatian bahawa akaun anda mungkin terjejas jika anda mempunyai akaun dengan kami dan menarik diri daripada komunikasi.

3.4 Pengguna dengan ini mengakui dan bersetuju bahawa WaterHippos boleh mengakses, mengekalkan dan mendedahkan maklumat dan kandungan akaun Pelanggan kepada mana-mana kawal selia undang-undang, atau pihak berkuasa kerajaan, pemilik hak yang berkaitan, atau pihak ketiga jika dikehendaki berbuat demikian oleh Undang-undang yang Terpakai menurut perintah mahkamah atau permintaan yang saholeh mana-mana pihak berkuasa kerajaan atau kawal selia yang mempunyai bidang kuasa ke atas Water Hippos menurut terma Dasar Privasi .

3.5 Pelanggan bertanggungjawab sepenuhnya untuk aktiviti yang berlaku pada akaun Pelanggan walaupun aktiviti atau penggunaan tersebut tidak dilakukan oleh Pelanggan, dan Pelanggan mesti memastikan kata laluan akaunnya selamat. Jika pertikaian undang-undang atau tindakan penguatkuasaan undang-undang dimulakan berkaitan dengan akaun Pelanggan atas sebarang sebab, Water Hippos boleh menamatkan akaun Pelanggan serta-merta dengan atau tanpa notis. Water Hippos tidak akan bertanggungjawab, secara langsung atau tidak langsung, dalam sebarang cara untuk sebarang kehilangan atau kerosakan dalam sebarang bentukyang ditanggung akibat, atau berkaitan dengan, kegagalan Pelanggan untuk mematuhi seksyen ini.

3.6 Pelanggan mesti memaklumkan Water Hippos dengan serta-merta tentang sebarang pelanggaran keselamatan atau penggunaan tanpa kebenaran akaunnya. WaterHippos tidak akan bertanggungjawab ke atas sebarang kerugian yang disebabkan oleh sebarang penggunaan tanpa kebenaran akaun Pelanggan.

4. PESANAN

4.1 Dengan membuat Pesanan pada Platform, Pelanggan menawarkan untuk membeli Produk pada dan tertakluk kepada semua terma yang terkandung di T&C untuk Produk ini serta Terma Lain. Perwakilan Produkdan/atau Perkhidmatan untuk jualan yang dibuat oleh Water Hippos melalui Platform bukan merupakan tawaran untuk menjual tetapi jemputan untuk Pesanan. WaterHippos berhak untuk menolak Pesanan, tanpa memberi sebarang sebab.

4.2 Pelanggan bertanggungjawab untuk memastikan bahawa terma Pesanan dan sebarang perihalan serta spesifikasi yang berkenaan adalah lengkap dan tepat sebelum meneruskan Pesanan anda dengan kami. Water Hippos berhak untuk menerima Pesanan secara keseluruhan atau sebahagian. Pembatalan Pesanan boleh dilakukan pada bila-bila masa sebelum penghantaran Produk diaturoleh Water Hippos, tertakluk sentiasa bahawa anda tidak akan dapat membatalkan Pesanan anda sebaik sahaja Pesanan telah diatur untuk penghantaran atau telah dihantar atau dalam keadaan lain yang ditetapkan oleh Water Hippos.

4.3 Sebarang sampel, lukisan, perkara deskriptif, atau pengiklanan yang dihasilkan oleh Water Hippos dan sebarang penerangan, spesifikasi atau ilustrasi yang terkandung dalam katalog, risalah dan/atau Platform ini dihasilkan untuk tujuan semata-mata untuk memberikan gambaran anggaran Produk yang diterangkan dalam mereka. Ia tidak boleh menjadi sebahagian daripada kontrak atau mempunyai sebarang kuasa kontrak.

4.4 Sebaik sahaja Pesanan diterima dan disiapkan setelah pembayaran Berjaya dibuat oleh Pelanggan, pemberitahuan e-mel akan dikeluarkan kepada Pelanggan, selepas itu Produk akan diaturkan untuk penghantaran oleh Water Hippos atau rakan kongsi logistik yang dilantik oleh Water Hippos mengikut terma dan syarat di bawah Klausa 6.

4.5 Walaupun Water Hippos akan mencuba dan memastikan bahawa semua butiran, penerangan dan harga yang dipaparkan pada Platform adalah tepat, kesilapan (termasuk kesilapan pemprosesan) mungkin berlaku. Water Hippos tidak menjamin bahawa perihalan Produk atau kandungan atau spesifikasi lain adalah tepat, lengkap, boleh dipercayai, terkini atau tiada kesilapan. WaterHippos juga berhak untuk mengubah Produk (termasuk spesifikasinya, butiran promosi, harga dan lain-lain.) yang tersedia di Platform.

4.6 Jika Water Hippos mendapati kesilapan dalam harga atau pembayaran Produk yang telah dipesan oleh Pelanggan, Water Hippos akan memaklumkan kepada Pelanggan tentang perkara ini secepat mungkin dan memberi Pelanggan pilihan untuk mengesahkan semula Pesanan pada harga yang betul atau membatalkannya. Jika Water Hippos tidak dapat menghubungi Pelanggan dalam masa dua (2) hari perniagaan, Pesanan tersebut akan dianggap dibatalkan. Jika Pesanan dibatalkan dan Pelanggan telah pun membayar untuk Produk, Pelangganakan menerima bayaran balik penuh berkenaan dengan Produk tersebut.

4.7 Maklumat yang berkaitan dengan Produk juga mungkin mengandungi kesilapan tipografi atau kesilapan lain atau ketidaktepatan dan mungkin tidak lengkap atau terkini. Oleh itu Water Hippos berhak untuk membetulkan sebarang kesilapan, ketidaktepatan atau ketinggalan dan menukar atau mengemas kini maklumat pada bila-bila masa tanpa notis terlebih dahulu. Water Hippos juga berhak untuk menolak untuk memenuhi sebarang Pesanan yang dibuat oleh Pelanggan berdasarkan maklumat pada Produk yang mengandungi kesilapan atau ketidaktepatan, termasuk, tanpa had, kesilapan, ketidaktepatan atau maklumat lapuk mengenai perihalan, spesifikasi, harga, penghantaran atau syarat pembayaran.

5. HARGA DAN BAYARAN

5.1 Harga dan bayaran akan ditadbir oleh T&C untuk Produk ini, Terma Lain dan butiran serta maklumat Produk apabila Pelanggan membuat Pesanan pada Platform. Sekiranya berlaku percanggahan antara T&C untuk Produk ini, Terma Lain dan Pesanan, Pesanan akan diguna pakai setakat konflik atau ketidakkonsistenan. Harga Produk hendaklah merupakan harga yang ditetapkan dalam Pesanan.

5.2 Harga Produk adalah tidak termasuk cukai jualan dan perkhidmatan (“SST”), kos dan caj penghantaran dan pengendalian Produk(“Caj Lain”), yang akan ditunjukkan kepada Pelanggan semasa membuat Pesanan. Rujukan kepada SST hendaklah secara automatik merangkumi semua cukai nilai tambah lain yang mungkin dikenakan oleh Kerajaan dari semasa ke semasa.

5.3 Anda harus membaca dengan teliti butiran Pesanan dan menyemak maklumat seperti harga, caj, dan terma dan syarat lain untuk Produk sebelum membeli Produk. Anda hendaklah membuat pembayaran untuk Produk apabila membuat Pesanan melalui Platform kami dengan menggunakan pelbagai kaedah pembayaran yang disediakan di Platform.

5.4 Water Hippos boleh invois Pelanggan untuk kos atau perbelanjaan lain yang ditanggung oleh Water Hippos pada atau pada bila-bilamasa selepas selesai penghantaran (“Invois”). Pelanggan hendaklah denganserta-merta membayar Invois sepenuhnya berdasarkan jangka masa untuk pembayaran seperti yang ditetapkan dalam Invois, jika gagal, Water Hippos berhak untuk mengenakan faedah pembayaran lewat pada kadar lapan peratus (8%) setahun,dikira setiap hari dari tarikh Invois perlu dibayar sehingga penyelesaian penuhyang sama.

5.5 Pelanggan hendaklah membayar semua amaun yang perludibayar di bawah Kontrak sepenuhnya tanpa sebarang tolakan, tuntutan balas,potongan atau penahanan (kecuali sebarang potongan atau penahanan yang dikehendaki oleh undang-undang). Water Hippos berhak pada bila-bila masa, tanpamengehadkan apa-apa hak atau remedi lain yang mungkin ada, menolak apa-apaamaun yang terhutang oleh Pelanggan terhadap sebarang amaun yang perlu dibayaroleh Water Hippos kepada Pelanggan.

5.6 Water Hippos berhak, dengan memberikan notis kepada Pelanggan pada bila-bila masa sebelum penghantaran, menaikkan harga Produk untuk menggambarkan sebarang kenaikan kos Produk yang disebabkan oleh:

sebarang faktor di luar kawalan kami (termasuk tetapi tidak terhad kepada kenaikan cukai dan duti, kenaikan buruh, pengangkutan,kelewatan, bahan dan kos pembuatan lain); atau
sebarang permintaan oleh Pelanggan untuk menukaralamat penghantaran, tarikh, kuantiti atau jenis Produk yang ditempah.

5.7 Water Hippos akan memberitahu Pelanggan jika atasapa-apa sebab Water Hippos tidak dapat memproses Pesanan Pelanggan, ataumana-mana bahagian daripadanya (dalam kes ini Water Hippos tidak akan menerima bayaran daripada Pelanggan berkenaan dengan Pesanan yang dibatalkan, atau sebahagian Pesanan yang dibatalkan). Keadaan di mana Water Hippos mungkin tidak dapat memproses dan menerima Pesanan termasuk tetapi tidak terhad kepada:

di mana Produk yang telah dipesan oleh Pelanggan tidak lagi tersedia dalam stok;
di mana pembayaran tidak dibenarkan;
di mana Water Hippos telah mengenal pasti kesilapan penerangan pada Produk; dan/atau
di mana Pelanggan tidak mematuhi dalam sebarang cara sekalipun dengan T&C untuk Produk ini danTerma Lain.

5.8 Water Hippos tidak bertanggungjawab untuk sebarangkehilangan atau kerosakan yang timbul daripada maklumat Produk dan/atau ketidakupayaan Water Hippos untuk memproses Pesanan Pelanggan dan/atau maklumat pembayar yang dimasukkan oleh Pelanggan atau pengiriman wang yang salah olehPelanggan berkaitan dengan pembayaran untuk Pesanan. Water Hippos berhak untuk menyemak sama ada Pelanggan diberi kuasa sewajarnya untuk menggunakan kaedah pembayaran tertentu, dan boleh menggantung urus niaga sehingga kebenaran tersebut disahkan atau membatalkan transaksi yang berkaitan di mana pengesahan tersebut tidak tersedia atau apabila Water Hippos telah mengesahkan bahawa transaksi yang berkaitan adalah pembayaran yang tidak dibenarkan.

5.9 Di mana berkenaan, Pelanggan menjamin bahawa butiran kad kredit atau debit yang Pelanggan berikan adalah daripada kad kredit ataudebit Pelanggan sendiri dan bahawa Pelanggan mempunyai dana yang mencukupi untuk membuat pembayaran.

6. PENGHANTARAN

6.1 Water Hippos akan mengaturkan Produk yang dipesan oleh Pelanggan ke lokasi yang ditetapkan dalam Pesanan atau lokasi lain yang dipersetujui oleh kedua-dua pihak (“Lokasi Penghantaran”). Water Hippos berhak,mengikut budi bicara mutlaknya, mengenakan bayaran kepada Pelanggan sebarangdan semua kos dan perbelanjaan penghantaran dan pengendalian Produk. Kos penghantaran dan/atau sebarang semakan sedemikian akan dipaparkan di Platformoleh Water Hippos dari semasa ke semasa. Penghantaran Produk hendaklahdiselesaikan semasa ketibaan Produk di Lokasi Penghantaran.

6.2 Pelanggan bertanggungjawab untuk memastikan bahawa Lokasi Penghantaran (termasuk akses kepada yang sama) adalah selamat danseterusnya memastikan bahawa Water Hippos mempunyai akses tanpa had dan tanpa halangan kepada yang sama. Pelanggan hendaklah menanggung rugi sepenuhnya WaterHippos terhadap sebarang kehilangan, kerosakan dan kecederaan yang mungkindialami Water Hippos akibat daripada pelanggaran Pelanggan terhadap kewajipannya yang dinyatakan di atas.

6.3 Sebarang tarikh yang disebut untuk penghantaran adalah anggaran sahaja, dan masa penghantaran bukanlah material.

6.4 Jika Pelanggan gagal menerima penghantaran Produk apabila Produk tiba di Lokasi Penghantaran, maka: -

Water Hippos atau rakan logistik yang dilantik oleh Water Hippos akan menghubungi anda untuk membuat temu janji lain untuk penghantaran. Walau bagaimanapun, ini akan menghasilkan pesanan penghantaran baharu dan oleh itu boleh dikenakan bayaran, atas perbelanjaan Pelanggan.Pelanggan hendaklah bertanggungjawab untuk kos dan perbelanjaan tambahan berhubung dengan penghantaran tersebut; dan
Water Hippos atau rakan logistik yang dilantik oleh Water Hippos akan menyimpan Produk sehingga penghantaran seterusnya berlaku,Water Hippos berhak untuk mengenakan bayaran kepada Pelanggan untuk semua kos dan perbelanjaan yang berkaitan termasuk kos penyimpanan dan Water Hippos tidak akan bertanggungjawab kepada Pelanggan bagi kerosakan kepada Produk yangberlaku dalam tempoh penyimpanan ini.

7. TAJUK, RISIKO DANPEMILIKAN

Risiko dalam Produk berpindah kepada Pelanggan semasa penghantarannya kepada Pelanggan menurut Klausa 6 T&C untuk Produk ini. Hakmilik dalamProduk akan diserahkan kepada Pelanggan apabila bayaran dijelaskan dengan penuh dan diterima oleh Water Hippos untuk harga Produk (termasuk sebarang kospenghantaran dan pengendalian yang berkenaan). Water Hippos berhak untuk mengakses, mengambil semula dan mendapatkan semula mana-mana Produk yang tidak dibayar sepenuhnya oleh Pelanggan.

8. KUALITI PRODUK

8.1 Water Hippos menjamin bahawa semasa penghantaran, dan untuk sebarang Tempoh Waranti, Produk adalah bebas daripada kecacatan material dalam bahan dan mutu kerja.

8.2 Tertakluk kepada Klausa 8.3 dan 8.4 di bawah,Pelanggan hendaklah memberi notis secara bertulis kepada Water Hippos:

dalam masa dua puluh empat (24) jam sekiranya berlaku kerosakan semasa penghantaran atau kecacatan yang boleh ditemui semasa pemeriksaan munasabah Produk selepas penerimaan penghantaran; atau
dalam kes kecacatan yang hanya boleh ditemui secara munasabah selepas tarikh penghantaran, dalam masa dua puluh empat (24) jam dari tarikh apabila Pelanggan boleh menemui kecacatan itu pada pemeriksaan munasabah terhadap Produk,

dan tertakluk bahawa Water Hippos diberi peluang untuk memeriksa Produk yang rosak tersebut (“Produk yang rosak”). Pelanggan hendaklah memulangkan Produk yang rosak tersebut kepada Water Hippos atau mengatur dengan Water Hippos untuk mengambil Produk yang rosak tersebut pada kos Water Hippos.

8.3 Water Hippos berhak, mengikut budi bicara mutlaknya, membaiki atau menggantikan Produk yang rosak tersebut, atau membayar balik harga Produk yang rosak tersebut sepenuhnya.

8.4 Water Hippos tidak akan bertanggungjawab untuk waranti yang dinyatakan dalam Klausa 8.1 di atas dalam mana-mana kejadian berikut: -

Pelanggan tidak mematuhi Klausa 8.2;
Pelanggan menggunakan selanjutnya Produk yang rosak tersebut selepas memberikan notis mengikut Klausa 8.2;
Kerosakan tersebut timbul kerana Pelanggan gagal mematuhi arahan lisan atau bertulis wakil ejen Water Hippos mengenai penyimpanan, pentauliahan, pemasangan, penggunaan dan penyelenggaraan Produk;
Pelanggan mengubah atau membaiki Produk tersebut tanpa kebenaran bertulis Water Hippos; atau
Kerosakan itu timbul akibat pakai dan lusuh yang saksama, kerosakan yang disengajakan, kecuaian, atau penyimpanan atau penggunaan yang tidak normal oleh Pelanggan.

9. POLISI PEMULANGANDAN BAYARAN BALIK

9.1 Melainkan dinyatakan sebaliknya oleh Water Hippos pada Platform ini atau pada terma jualan untuk Produk, WaterHippos mempunyai polisi pemulangan 30 hari. Water Hippos akan menerima pemulangan Produk untuk pengembalian harga pembelian, ditolak kos penghantaran dan pengendalian asal, dengan syarat pemulangan tersebut dibuat dalam tempoh tiga puluh (30) hari selepas penghantaran dan Produk tersebut dipulangkan dalam keadaan asalnya (iaitu, Produk tersebut tidak pernah digunakan, belum dibuka, dalam pembungkusan asal dan dalam keadaan yang sama). Pelanggan harus memastikan Produk tersebut termasuk sebarang produk-produk pelengkap seperti komponen dan/atau aksesorinya yang disertakan bersama Produk tersebut, dikembalikan kepada Water Hippos. Water Hippos berhak menolak pemulangan Produk tersebut jika terdapat kerosakan pada Produk tersebut dan/atau pada pembungkusan Produk tersebut oleh Pelanggan (selain daripada kerosakan yang disebabkan oleh Water Hippos semasa penghantaran).‍

9.2 Untuk layak menerima pemulangan dan bayaran balik, Water Hippos mesti dimaklumkan dalam jangka masa tiga puluh (30) hari dari tarikh penerimaan Penghantaran oleh Pelanggan. Selepas tiga puluh (30) hari dari tarikh penerimaan, Water Hippos tidak bertanggungjawab dengan sebarang cara untuk menerima pemulangan Produk dan membayar balik sebarang wang yangtelah dibayar untuk Produk tersebut atas sebarang sebab.‍

9.3 Sekiranya di mana Water Hippos telah menerima Produk tersebut untuk dipulangkan, Pelanggan dikehendaki menghantar Produk kepada WaterHippos atau mengatur pengambilan dengan Water Hippos atas kos Pelanggan. Sekiranya terdapat produk yang rosak atau tidak betul atas kesalahan WaterHippos, Water Hippos akan menanggung semua kos yang berkaitan dengan pemulangandan bayaran balik atau penggantian, termasuk kos penghantaran. Jika pemulangan bukan kesilapan Water Hippos, sebarang kos yang berkaitan dengan pemulangan hendaklah ditanggung oleh Pelanggan.‍

9.4 Pelanggan hanya akan dibayar balik selepas WaterHippos telah menerima Produk yang dipulangkan oleh Pelanggan. Bayaran balik akan dikreditkan ke kad kredit/debit Pelanggan, akaun bank yang ditetapkan atau secara tunai, yang mana diguna untuk pembayaran Produk tersebut.‍

9.5 Untuk mengelakkan keraguan, sebarang wang yang akan dikembalikan menurut permohonan yang berjaya hendaklah tertakluk kepada potongan caj pentadbiran seperti yang mungkin dikenakan oleh Water Hippos, dari semasa ke semasa, mengikut budi bicara mutlaknya atau apa-apa caj lain yang mungkin dikenakan oleh mana-mana pihak ketiga.‍

10. WARANTI

10.1 Melainkan dinyatakan sebaliknya oleh Water Hippos pada Platform ini atau pada terma jualan untuk Produk, Produk Water Hippos' biasanya dijamin oleh waranti dalam tempoh waranti yang dinyatakan dalam dan tertakluk kepada helaian waranti masing-masing (“Helaian Waranti”) untuk setiap Produk (“Tempoh Waranti”). Untuk layak mendapat waranti, ( i ) Produk yang dibeli mestilah secara terus melalui Water Hippos’ Platform, pengedar sah dan pembekal perkhidmatannya (“Pengedar Sah”); dan (ii) Pelanggan hendaklah mematuhi T&C untuk Produk ini. Bukti tarikh pembelian dan bukti hak milik akan diperlukan semasa membuat tuntutan di bawah waranti ini. Syarat-syarat dalam Helaian Waranti merupakan sebahagian daripada syarat T&C untuk Produk ini. Jika terdapat percanggahan antara T&C untuk Produk ini dan Helaian Waranti, syarat dalam Helaian Waranti akan diguna pakai, setakat ketidakkonsistenan tersebut.‍

10.2 Walaupun peruntukan di sini, jika Produk dibeli oleh Pelanggan daripada penjual pihak ketiga (“Penjual Pihak Ketiga”), yang bermaksud pihak selain daripada Pengedar Sah Water Hippos, semua perkara berkaitan waranti adalah dikawal oleh polisi waranti yang berkaitan Penjual Pihak Ketiga. Water Hippos tidak akan bertanggungjawab untuk memudahkan dan/atau mematuhi dasar waranti Penjual Pihak Ketiga. Anda bersetuju untuk mengetepikan sebarang tuntutan terhadap Water Hippos berkenaan dengan Penjual Pihak Ketiga dan akan membawa sebarang tuntutan yang mungkin anda ada terhadap Penjual Pihak Ketiga.‍

10.3 Water Hippos berhak untuk memindahkan komponen atau bahagian yang berfungsi sepenuhnya daripada mana-mana Produk yang rosak, jika diperlukan. Sebarang komponen atau bahagian yang diganti akan menjadi hak milik kami.‍

10.4 Anda hendaklah dengan segera melaporkan kepada kami dalam Tempoh Waranti apa-apa kerosakan pada Produk yang disebabkan oleh kerosakan pada bahan. Sebaik sahaja tuntutan waranti anda diterima oleh WaterHippos, Water Hippos berhak menyiasat punca bahagian dan/atau komponen yangrosak dan jika Water Hippos menentukan bahawa kerosakan pada Produk adalah akibat daripada kerosakan pengilang dalam bahan, kami akan membaiki atau,mengikut budi bicara tunggal dan mutlak kami, menggantikan mana-mana bahagian dan/atau komponen yang rosak dalam Tempoh Waranti. Semua tuntutan mesti dibuat dalam Tempoh Waranti masing-masing. Untuk mengelakkan keraguan, penggantian bahagian dan/atau komponen oleh Water Hippos kepada Pelanggan tidak termasuk sebarang perkhidmatan sampingan seperti penghantaran , pemasangan, ujian dan penyelenggaraan, Water Hippos berhak untuk mengenakan kos tambahan untuk sebarang perkhidmatan sampingan tersebut jika diminta oleh Pelanggan.‍

10.5 Semua Produk mesti dipasang oleh anda mengikut arahan pemasangan dan/atau manual, dibekalkan dengan Produk tersebut dan mengikut semua keperluan undang-undang yang berkaitan.‍

10.6 Jika komponen yang rosak diganti di bawah waranti ini, baki Tempoh Waranti akan kekal berkesan. Walau bagaimanapun, Pelanggan hendaklah mengambil perhatian bahawa bahagian yang diganti tidak membawa waranti baharu.‍

10.7 Waranti hanya terpakai kepada Produk dengan bahagian komponen asal atau tulen dan oleh itu tidak meliputi mana-mana paip atau bahagian elektrik yang dibekalkan oleh pemasang pihak ketiga dan bukan bahagian penting pemanas air, seperti injap pengehad tekanan, batang henti , injap tidak kembali, suis elektrik, pam atau fius.‍

10.8 Waranti kami akan terbatal dan tidak sah sekiranya mana-mana bahagian Produk telah dibongkar dan dipasang semula, bahagian ditukar atau dibaiki oleh mana-mana pihak ketiga selain daripada Water Hippos atau juruteknik atau ejen yang sah oleh Water Hippos.‍

10.9 Water Hippos tidak akan bertanggungjawab kepada kos utiliti yang ditanggung untuk tuntutan waranti ini.‍

10.10 Waranti untuk Produk tidak akan terpakai kepada yang berikut, di mana pembaikan akan dilakukan dengan kos Pelanggan: -‍

kerosakan dan/atau kecacatan yang disebabkan oleh pakai dan lusuh biasa, penggunaan tidak wajar atau salah urus, pengendalian Produk dan bukannya mengikut manual pengendalian atau arahan atau helaian lampiran, penggunaan Produk dengan cara yang tidak difikirkan secara munasabah oleh Water Hippos, tanpa kebenaran pengubahsuaian Produk atau tertakluk kepada Produk kepada fizikal, persekitaran, tekanan elektrik yang luar biasa atau tidak disyorkan, paip rosak atau tekanan air tinggi;
kerosakan yang disebabkan, secara langsung atau tidak langsung oleh tekanan air yang berlebihan, suhu dan/atau input haba atau suasana menghakis;
kerosakan kosmetik, termasuk tetapi tidak terhad kepada penyok, retak, calar dan noda;
kerosakan yang disebabkan oleh ujian, demonstrasi, penyelenggaraan, pemasangan, pelarasan atau pengubahan yang tidak betul;
kerosakan yang disebabkan oleh sebahagian atau bahagian Produk yang tidak dibekalkan atau diluluskan oleh Water Hippos;
kerosakan yang disebabkan oleh servis atau pembaikan yang dilakukan oleh sesiapa sahajayang bukan wakil kepada Water Hippos atau juruteknik atau ejen sah WaterHippos;
kerosakan yang disebabkan oleh kemalangan, penderaan, banjir, kebakaran, angin, gempa bumi, kilat atau sebab luaran lain; dan/atau
pengecualian lain seperti yang ditetapkan dalam helaian jaminan masing-masing.

10.11 Waranti ini tidak terpakai kepada mana-mana bahan habis pakai. Tiada waranti dikenakan pada hayat mana-mana kartrij penapisan yang dipasang dalam Produk kerana hayat kartrij mungkin berbeza mengikut kualiti air dan kadar penggunaan air.‍

10.12 Produk(-produk) Water Hippos direka khusus untuk digunakan di lokasi kediaman domestik. Melainkan dibenarkan sebaliknya oleh Water Hippos, pemasangan yang tidak sesuai, seperti dalam persekitaran komersial (termasuk rumah jagaan kediaman atau kemudahan perubatan), akan membatalkan jaminan.‍

10.13 Setakat yang dibenarkan oleh undang-undang, waranti ini mengecualikan mana-mana dan semua tuntutan untuk kerugian atau kerosakan yang dialami oleh Pelanggan melalui penggunaan atau akibat daripada Produk tidak beroperasi atau tidak berkesan atau mana-mana bahagiannya termasuk kerugian atau kerosakan kepada mana-mana barangan lain, perabot dan/atau harta dalam sebarang perihalan atau apa-apa kerugian atau kerosakan berbangkit yang lain sama ada secara langsung atau tidak langsung disebabkan oleh kecuaian, kehilangan penggunaan, tidak berfungsi, kecacatan, kerosakan, kerosakan atau kebocoran daripada Produk apa pun dan walau bagaimana pun timbul.‍

11. BEKALAN PERKHIDMATAN

Apabila Pelanggan membeli Produk yang berkaitan dengan Perkhidmatan, peruntukan Perkhidmatan tersebutakan ditadbir oleh terma dan syarat untuk penyediaan Perkhidmatan.

12. LIABILITI DAN INDEMNITI

Water Hippos tidak akan bertanggungjawab ke atas sebarang kehilangan, kerosakan atau kecederaan (termasuk kerosakan harta benda) yang timbul daripada atau berkaitan dengan T&C untuk Produk ini dan Terma lain atau disebabkan atau disumbangkan dalam apa-apa cara melalui penggunaan dan pengendalian Produk. Walauapapun peruntukan lain dalam T&C untuk Produk ini dan Terma lain,sekiranya Water Hippos bertanggungjawab untuk kehilangan atau kerosakan, jumlah liabiliti Water Hippos kepada Pelanggan atau kepada mana-mana pihak lain hanya terhad kepada harga pembelian Produk tersebut.

13. KESILAPAN DALAM DOKUMEN WATER HIPPOS

Kesilapan dan salah cetak dalam pengiraan, menaip atau sebaliknya dalam Platform ini, penerangan Produk, spesifikasi dan/atau dokumentasi Water Hippos termasuk tetapi tidak terhad kepada katalog, senarai harga, sebut harga, doket penghantaran, invois dan penyata, atau nota pelarasan adalah tertakluk kepada pembetulan oleh Water Hippos melalui pengeluaran semula dokumen atau melalui nasihat pelarasan.

14. PENGECUALIAN

Tiada kelakuan oleh Water Hippos berkenaan dengan mana-mana keingkaran Pelanggan dan pelaksanaan mana-mana kewajipan atau syarat T&C untuk Produkini akan dianggap sebagai penepian kewajipan atau syarat lain itu.

15. VARIASI

Water Hippos berhak pada bila-bila masa, mengikut budi bicara mutlaknya, untuk menukar, meminda atau sebaliknya mengubah suai mana-mana bahagian T&C untuk Produk ini dengan menyiarkan pindaan dan menyatakan semula T&C untuk Produk pada Platform. Pindaan sedemikian berkuat kuasa pada tarikh siaran, dan penggunaan berterusan Platform Water Hippos menandakan penerimaan kemas kini atau ubah suai T&C untuk Produk ini.
